On this day 12/1/2011 ninety seven United States Senators became the enemy of the U.S. Constitution. There were only seven senators that voted against SB 1867. The bill that authorizes the President to arrest and detain American citizens that he deems a threat to the country or his administration. Yesterday , Sheriff Mack was on Freedom Watch with the Judge. He was understandably furious with SB 1867s passage in the Senate. He said what Ive been saying for the past 11 years. The following are two of our posts,. We believe that before this is over, some form or fashion of the following will be required,if America and our Constitution is to be saved. The current implosion of the 17 EU countries attempt at Unionization is proof , that it does not work. The Soviet Union is another example of failed unionization of states.

I just wanted to point out that the bill to which you refer apparently is actually SB 1867 not 1687 (which deals with national forest boundaries in New Mexico) S.1867 — National Defense Authorization Act for Fiscal Year 2012 (Engrossed in Senate [Passed Senate] – ES)http://thomas.loc.gov/cgi-bin/query/z?c112:S.1867:
I have looked through the bill (but not read it completely because it is over 900 pages)and sections 1031 to 1036 I think are the relevant ones. I and not a lawyer and I do not trust what is in this bill, but do not see where those sections authorize the President to arrest and detain American citizens that he deems a threat to the country or his administration. I know McCain sponsored S. 551: Military Detainee Procedures Improvement Act of 2011 http://www.govtrack.us/congress/bill.xpd?bill=s112-551 but that is still in committee.
In March 2010 McCain and Lieberman introduced Text of S. 3081 [111th]: Enemy Belligerent Interrogation, Detention, and Prosecution Act of 2010 http://www.govtrack.us/congress/billtext.xpd?bill=s111-3081 that put a lot of power in the executive branch but that never became law.
Both of McCain’s earlier effors seem more dangerous than the current one. The current law puts discretion of release of detainees specifically from Gitmo in the hands of the Secretary of Defense “make discretionary determinations whether or not a detainee represents a continuing threat to the security of the United States; (2) clarify that the Secretary of Defense is responsible for any final decision to release or transfer an individual detained in military custody at United States Naval Station, Guantanamo Bay, Cuba, pursuant to the Executive Order referred to in subsection (a),”
Covered persons are defined as
(b) COVERED PERSONS.—A covered person under this section is any person as follows:
(1) A person who planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored those responsible for those attacks.
(2) A person who was a part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners, including any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces.
The definition of covered persons gets muddied when the current law refers to other laws and changes in those other laws that supplement the new one. An attorney’s perspective would be great if there is one out there.

I think going forward we will see States AGs, drafting opinions. Im hoping that Utahs, Senator Mike Lee will produce a qualified doc that will explain the concerns we all have regarding this legislation. I have emailed a Utah reader friend and asked him to contact Senator Lee’s office for something in writing. We’ll see .

It seemed like a small earthquake but it wasn’t.
No, the shifting ground was caused by the corpses of Benjamin Franklin, George Washington, Thomas Jefferson, James Madison, John Adams, Alexander Hamilton, Samuel Adams, Patrick Henry, John Hancock, Thomas Paine, Roger Sherman, John Jay, James Wilson, and Gouvernor Morris as well as every body in Arlington and every military cemetery in America rolling over in their graves as the Constitution was just RAPED by a majority of the US Senate.
It troubles me just as much seeing the names of once conservative and Constitutionally literate senators who were either unaware of the Levin/McCain/Kyl bastardization of our civil rights. Were they unaware or pressured?
And what is perhaps more amusing is seeing the names of Senators who just 10-years ago screamed bloody murder over the (un)Patriot Act and the supposed right of terrorists… yet here they are doing the same to the American citizenry. Hypocrites or fall-in-line Progressives out to destroy this nation and the Liberty we were blessed with?
Anyone reading this message PLEASE contact your representatives and urge them to dump this horrendous slaughter of our rights should it make it’s way to the house with these fascists provisions intact.
We have enough to worry about from Obama and his merry little band of czars, regulators and unelected bureaucrats as they rape the Constitution “under the radar”.

Hi Jim,,, your correct of course, it is SB 1867 , thanks for the heads up,…. As for the actual language, what we’ve learned so far is that they have not considered this bills unintended consequences… When we have a better explanation of their ability to come thru the back door , we will put it up. Thanks again. I should have recognized the 1687 as the forest service boundaries in New Mexico… For more on this , a great reference book is “The Administrative Presidency Revisited” public lands, the blm, and the Reagan Revolution.
I heard someone say yesterday , that Obama had said he would not sign SB1867, but we have not confirmed that!

Hopefully this will die in the house, but if not, the unconstitutional provisions will be struck down at some time. It is a shame our lawmakers don;t have a better understanding about law. I suspect the vast majority of them don’t take the time to read and understand what they are voting on. And that lazy is as troubling as anything else. David Lee Valdina 12/2/11
